If you go to an interview, and after the interview, OPMC or OPD decides to charge you with misconduct, you are in the fight of your life. What can happen is that you can lose your license out of this. The way this works is they select a panel of three people, professional people, to act as jury. There’s an administrative law judge, your attorney, and an attorney from the state. The state will present witnesses and documents, and make the case that you should either lose your license or be on probation or have some other sanction.
Whatever the story is, you have to fight this as best you can. If you cannot fight it successfully, then you have to try to reach the best possible agreement with the state. In no event do you want to have your license at risk to be revoked, although sometimes, they will take nothing but a revocation, and therefore you have to go ahead with the hearing. It is a very, very emotional and difficult problem, and one you want to try to avoid. If you can’t, then you have to go and be prepared. Have witnesses, and be prepared to talk yourself and defend your position.
